Athletic Eligibility

John Rue & Associates has successfully represented parents seeking to challenge a determination of ineligibility to play high school sports.  These matters are administrative, and must be addressed through the New Jersey State Interscholastic Athletic Association, which conducts factual hearings and makes the determination.

Important statutory or constitutional issues can come into play in these cases.  For example, the right of a student to due process (which is comprised of reasonable notice to the student of both the process and the outcome of an eligibility determination, and the opportunity to object to either) could be at issue.  If an adverse decision is caused by improper discrimination, a cause of action may lie in civil court.
