This Firm routinely offers to utilize creative fee structures to shift some of the risk of paying our fees away from clients and to the defendants in the lawsuits our clients bring. This is possible because most of our cases are brought under statutes such as the IDEA, which provides that a parent who prevails against a school district is entitled to payment of the reasonable value of the legal services utilized to obtain that victory. So we are able, when the merits of the case warrant it, to accept only partial payment of our ordinary fees, with the balance deferred to the end of the case, to be either paid by the defendant (if we win) or waived (if we lose).
